CONDITIONS
1. General
1.1 NEFF home appliances are proudly distributed by BSH Home Appliances Pty Ltd (ACN 109 198 405) of 1555 Centre Road, Clayton, Victoria, 3168 (BSH).
1.2 From time to time, BSH may host free or paid classes and events at ‘The NEFF Kitchen’.
1.3 Upcoming ‘The NEFF Kitchen’ classes and events can be viewed at www.theneffkitchen.com.au/masterclass/ .
1.4 Participants under the age of 18 must be supervised by an adult for the entire duration of the class or event.
1.5 Subject to conditions 4.1 and 8.2, by booking a class or event you are accepting these conditions.
2. Bookings
2.1 All bookings must be made via ‘The NEFF Kitchen’ webpage www.theneffkitchen.com.au/masterclass/ .
2.2 Registrations for ‘The NEFF Kitchen’ classes and events are limited, and bookings are required.
2.3 Where classes or events require payment, bookings will not be secured until full payment is received.
2.4 Class and event prices include GST.
2.5 Bookings will be confirmed via email.
2.6 If you have registered for a class and/or event but have not received e-mail confirmation please contact ‘The NEFF Kitchen’ via email at neffshowroom@bshg.com or call (03) 8551 1316.
2.7 BSH reserves the right to refuse a booking at its sole discretion, acting reasonably.
3. Payments
3.1 Payment (where applicable) is required at the time of booking and can be made via credit card.
3.2 Payments for classes and events may be facilitated by BSH’s payment processing and website hosting providers that may request further credit card and identification information for validation procedures.
3.3 While BSH and its processing and website hosting providers employ secure technology for transactions, BSH (including its officers, employees, and agents) will not be liable for any loss or damage suffered by a customer whose credit card or bank information is misused or stolen as a result of a customer utilizing those technologies.
4. Cancellations
4.1 Cancellations made at least five business days prior to the class or event may be transferred to another person, rescheduled or a full refund requested.
4.2 Cancellations made between five days and 48 hours prior to the class will incur a cancellation fee of 50 percent of the class or event purchase price.
4.3 Cancellations made less than 48 hours prior to a class or event and ‘no-shows’ will not be refunded.
4.4 BSH reserves the right to cancel classes and events with 24 hours’ notice if necessary and reasonable to do so. In this instance, a full refund will be provided.
5. Menu and Allergies
5.1 BSH reserves the right to change any menu(s) (if applicable) without notice.
5.2 All attendees must make food allergies known to BSH at the time of booking and upon commencement of the class or event.
5.3 As a fully operational showroom, nuts, wheat, dairy, fish and other ingredients may be used.
5.4 BSH cannot ensure that food will not contain traces of nuts, wheat, dairy, fish, and other ingredients.
6. Classes and Events
6.1 All classes and events will start on time. BSH advises customers to arrive 15 minutes early.
6.2 If an attendee is deemed unwell or unfit to attend (e.g. cold, flu, intoxicated, vomiting, causing harm), BSH may refuse the attendee entry into the showroom, or request that the attendee leaves the class or event immediately.
6.3 If participating in cooking classes, BSH requires attendees to wear closed-toe footwear and appropriate clothing.
7. Liability
7.1 Nothing in these Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, BSH (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of any ‘The NEFF Kitchen’ classes and events where it is fair and reasonable to do so.
7.2 Any attendee who damages BSH property including, but not limited to, walls, doors and appliances as a result of inappropriate conduct will be pursued for costs.
8. Privacy
8.1 BSH collects personal information (PI) in order to conduct the ‘The NEFF Kitchen’ classes and events and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. BSH will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.neff.com.au (follow the ‘Privacy’ link) or by calling BSH Home Appliances Customer Service on 1300 087 033. In addition to any use that may be outlined in BSH’s Privacy Policy, BSH may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the attendee. The Privacy Policy also contains information about how attendees may opt out, access, update or correct their PI, how attendees may complain about a breach of the Australian Privacy Principles or any other applicable laws and how those complaints will be dealt with. Unless otherwise indicated by BSH, BSH may disclose PI to entities outside of Australia (for a list of the countries, see the BSH’s Privacy Policy).
8.2 Classes and events may be photographed or filmed for promotional purposes. If you do not wish to be filmed or have your photo taken, please notify BSH staff prior to the commencement of the class or event.
